In case of disobedience to police officers or TCK members, administrative detention can take place under protocol for up to three hours - Major Kozak

If a citizen disobeys police officers or employees of the Territorial Recruitment and Social Support Centres (TCK), they can carry out administrative detention of a citizen for up to three hours under the protocol, and if a citizen uses physical influence, the detention period can last three days, said Deputy Chief of the Territorial Recruitment and Social Support Centre in the city of Kyiv, Major Larysa Kozak.

At a press conference at the Interfax-Ukraine news agency on Tuesday, Kozak explained that at the legislative level, police officers in warning groups and employees of the TCK are allowed to search for citizens who evade the established rules of military registration. She pointed out that “this covers the issue of both detention and transportation” to the premises of the TCK, which is regulated by law.

At the same time, Kozak stressed that in order to comment on the actions of the employees of the TCK, which are distributed on the web, one needs to watch the full videos.

“In my practice, the following happens: citizens who are wanted, and there is an established fact of sending a message to the competent authorities of the National Police, they are invited to voluntarily go to TCK to update the data or remove the obstacles that contributed to their placement on the wanted list. If a citizen insubordinates either police officers or employees of the TCK, there is a corresponding provision in the Code of Administrative Offenses, which allows a police officer to carry out administrative detention of a citizen under the protocol, which has a certain period of up to three hours,” the TCK employee explained.

According to Kozak, if a citizen insubordinates with the use of physical force, including in relation to military personnel, the period of such detention can last even three days.

“If we are talking specifically about those videos where, as it seems to the public, citizens are forcibly placed in vehicles, then if we analyze them in full, it was done because of insubordination, there was an administrative protocol on detention, and accordingly, an appropriate administrative penalty in the form of a fine or the sanctions of the article stipulated by the Code of Administrative Offenses is imposed on a person after bringing him to the National Police or the TCK,” said the major.
